Eagles sue Hotel California in
Todos Santos for misuse of name of their most famous song.
Everybody knows the song.
And everybody reading this
probably, probably also knows of the
famous “Hotel California” in Todos Santos, in Baja California.
Visitors flock to this immensely
popular, iconic hotel. Many believing it was the inspiration for the famous Eagles
song. And apparently, the owners who bought the place in 2001, have actively encouraged
this belief. By constantly playing the song, and selling t-shirts and other
merchandise.
Funnily enough The Eagles are
not happy about this. The hotel was not the inspiration for their song. And they
have never actually been there. Not surprisingly they have decided to sue for damages.
And for infringement of intellectual property rights. Because the hotel owners
have also filed an application with the Patent and Trademark Office to register
the name “Hotel California”. So things could get very interesting.
The hotel has been in operation since 1950. It was originally called the Hotel
California. But it has gone through a series of name changes over the years.
And it was the 2001 owners who actively started cashing in on the name.
However, the hotel has just changed
hands. Which may also complicate things. And it is not clear if it was the previous
or new owner who has filed the patent.
Whatever, the outcome - Todos Santos is a fabulous place to
visit
